The Rocky Bayou Owners Association, Inc Annual Meeting was held as scheduled on 3 March 2009, beginning at 7:00 PM at Niceville City Hall.

Unfortunately, a quorum of 104 members was not reached either by proxy or attendance so the meeting was not official and no decisions were made by the membership.  There was discussion but no vote on the fining amendment.  In general, the amendment was considered favorably by a majority of the proxies and members attending.

Dave Ladd, President, opened the meeting and introduced the Board of Directors present; Bill Osthoff, Vice President, Paul Maryeski, Treasurer, Al Haberbusch, Architectural Control, Linda Blythe, Administrative.  Directors not attending: Bill Patrick, Environmental and Frank Strasburger, Maintenance.  Also present were Paul Grimmig and Garey Cathey who serve on the Architectural Control Committee.

Importantly, three Board Members are leaving the Board and replacements need to be found.  Those leaving include: Dave Ladd, President, Frank Strasburger, Maintenance and Bill Patrick, Environmental.  The Board would like to see representation from Unit 1 of the association which is the Golf Course Drive, Sharon, and Marion street areas.  The Board would also like to see lakefront property representation.  The association lakes are:  Henderson, Werk,  Amick, Phelps and Kenney.  Going forward no board member is a lakefront property owner.

The Board of Directors and committee members serve as volunteers for two year terms.  Dave Ladd has been president for four years and is very responsible for the many improvements  throughout the 400 member property area.  Everyone thanked Dave for his fine leadership in addressing and solving the Henderson Dam problem.

Three property owners from Units 1 & 2,  have asked to join the association.  Legal action is pending.

Paul Maryeski, reviewed a recent lawsuit involving the association.  A member property owner in Unit 2 (Diane St) sued the association (October 3, 2009) stating that the association did not have the authority to collect annual dues against his property in this unit and asked for reimbursement for dues paid in 2004, 2005 & 2006 and legal costs totaling $494.00.  Mediation was not successful and the case was heard on 8 January 2009 by the Honorable Judge Ward.  The association was represented by counsel (Becker & Poliakoff).   Judge Ward ruled in the association’s favor.

The Board of Directors thanks those members attending and those members who were represented by proxy.  The Board also thanks all members of the association for the support and confidence during the past year.
