Covenant Enforcement

The Rocky Bayou Owners Association (RBOA) Board receives complaints regarding violations of the restrictive covenants on an ongoing basis. The Board has adopted a more assertive position regarding covenant enforcement. Violators will be notified by certified mail and given an opportunity to correct the violation(s). The initial approach will include the possibility of a fine levied by the Board as defined and implemented by amendment to the association’s bylaws.

Continued violation will be referred to the Association’s attorney for legal action. Members of the RBOA Board will regularly monitor all units for covenant violations. If you become aware of a covenant violation, please contact a member of the RBOA Board (or email compliance@rboa.net).

Copies of the restrictive covenants applicable to your unit/lot are available on the Covenants page. If you are not familiar with your restrictive covenants, please read the covenants applicable to your unit/lot. (You can also use the By Laws/Corporate section of the site to look up your unit and lot number via the Member Property Listing.)

The Board has authority to enforce the Governing Documents (restrictive covenants/Declaration, Articles of Incorporation, Bylaws, and Rules & Regulations) by legal means. This includes the power to adopt and amend reasonable Rules and Regulations concerning the use, appearance, maintenance, and occupancy of parcels and common areas. The Board may impose reasonable fines and/or suspend Common Area use rights for failure to comply (subject to notice, opportunity to cure, and the procedures in the Bylaws/Declaration and applicable Florida Statutes). Architectural control is also actively enforced to protect community standards and property values.

Proposed Amended and Restated Bylaws and Articles (intended to more fully align the documents with current Florida law) did not receive the required vote for adoption; further revisions are planned. Florida law governs and supersedes any conflicting older provisions.
